Brij Bhushan claims contradiction in witness account

Former Wrestling Federation of India chief and BJP MP Brij Bhushan Sharan Singh on Saturday urged a Delhi court to free him in a sexual harassment case filed by six female wrestlers, alleging contradictions in the statements of the prosecution’s witnesses.

Represented by advocate Rajeev Mohan, the accused also submitted that as per law, the monitoring committee formed to probe the case had to recommend registration of FIR within seven days.

But “since in the matter at hand no such recommendation has been made, it is safe to assume that the Oversight Committee did not find a prima facie case against the accused,” he said.

Meanwhile, the judge granted Singh exemption from personal appearance during that day at the request of his lawyer.

“Since the Monitoring Committee did not discover any prima facie case, and since no case was discovered, no FIR was registered, and since no FIR was registered, it automatically amounts to an exoneration,” the lawyer told the court. .

The defense counsel further submitted that the statements made before the Monitoring Committee and the statements recorded under section 164 CrPC have material contradictions and that “the statements made subsequently (under section 164) have material improvements and therefore can be rejected outright.”

“Since there are material contradictions in the statements of the prosecution witnesses, that in itself calls for the release of the accused, since the contradictions have the effect of moving the case away from the realm of serious suspicion and closer to mere suspicion.” said the lawyer.

The argument was opposed by the prosecutor, who said that the constitution of the Supervisory Committee itself did not comply with the law.

“This is not an exoneration because said committee has not issued recommendations or conclusions,” said the prosecutor.

The judge will hear the matter again on October 30.

The city police had filed a charge sheet in the case against Singh, a six-time MP, on June 15 under sections 354 (assault or criminal force on a woman with intent to outrage her modesty), 354A (sexual harassment ), 354D (harassment) and 506 (criminal intimidation) of the IPC.

The police had also accused Vinod Tomar, the suspended deputy secretary of the WFI, in the case.
